Terms of Service

1. Acceptance of Terms

By accessing or using Investors.Cards (the "Service"), available at investors.cards, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

Investors.Cards is a market data and price tracking platform for trading card game (TCG) collectibles. The Service provides pricing data, historical price trends, portfolio tracking tools, price alerts, and market analysis across multiple TCGs including Pokémon, Magic: The Gathering, Disney Lorcana, One Piece TCG, and Riftbound. The Service is offered in multiple tiers (Free, Pro, and Premium) with varying levels of feature access as described on our Pricing page. Pricing data is sourced from third-party providers and may be delayed.

3. Not Financial or Investment Advice

All data, analysis, charts, statistics, and tools provided on this platform are for informational and entertainment purposes only. Nothing on the Service constitutes financial advice, investment advice, trading advice, or any other kind of professional advice. Trading cards are collectibles, not securities or regulated financial instruments. Past performance does not guarantee future results. The value of trading cards can go up or down. We are not registered investment advisors, broker-dealers, or financial planners. You should not make any purchase, sale, or investment decision based solely on information from this Service. Always conduct your own research and consult with qualified professionals before making financial decisions.

4. User Accounts

To access certain features of the Service, you must create an account by authenticating through Google or Discord. You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account and use the Service. You are responsible for maintaining the confidentiality and security of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

  • Use automated tools, bots, scrapers, crawlers, or similar technology to access, extract, or index data from the Service without our prior written authorization
  • Attempt to gain unauthorized access to any portion of the Service, its systems, or networks
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to reverse-engineer, decompile, or disassemble any portion of the Service
  • Reproduce, redistribute, or resell data obtained from the Service for commercial purposes without authorization
  • Use the Service to compete directly with Investors.Cards
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation
  • Upload or transmit viruses, malware, or other harmful code
  • Exceed reasonable usage limits or abuse API endpoints

6. Data Accuracy and Availability

While we strive to provide accurate and up-to-date pricing data, we make no warranties or representations regarding the accuracy, completeness, reliability, or timeliness of any data displayed on the Service. Pricing data is sourced from third-party providers and may be delayed, incomplete, or contain errors. We are not responsible for any decisions made based on data from the Service. The Service may experience downtime, interruptions, or data delays due to maintenance, third-party API limitations, or other factors beyond our control.

7. Intellectual Property

The Service, including its design, code, text, graphics, logos, and the selection and arrangement thereof, is owned by Investors.Cards and is protected by copyright, trademark, and other intellectual property laws. Trading card names, images, and related trademarks are the property of their respective owners (including but not limited to The Pokémon Company, Wizards of the Coast/Hasbro, Disney/Ravensburger, Bandai, and others). Our use of these names is for informational purposes and does not imply endorsement or affiliation.

8. Affiliate Links and Third-Party Services

The Service contains affiliate links to third-party marketplaces including TCGPlayer and eBay. When you click these links and make a purchase, we may earn a commission at no additional cost to you. These third-party services are governed by their own terms and conditions. We are not responsible for the products, services, or practices of any third-party website or service.

9. Subscription Plans and Payments

9.1 Subscription Tiers. The Service offers three tiers: Free, Pro, and Premium. The Free tier provides limited access to features as described on our Pricing page. Pro and Premium tiers are paid subscriptions that unlock additional features. Feature availability and limits for each tier are described on the Pricing page and may be updated from time to time.

9.2 Billing. Paid subscriptions are billed in advance on a recurring basis — either monthly or annually, as selected at the time of purchase. All prices are listed in U.S. dollars (USD). Payment processing is handled by Stripe, Inc. By subscribing, you authorize Stripe to charge your selected payment method on a recurring basis until you cancel.

9.3 Auto-Renewal. Subscriptions automatically renew at the end of each billing period (monthly or annually) at the then-current rate unless you cancel before the renewal date. We will not provide additional notice of renewal beyond what is stated in these Terms.

9.4 Cancellation. You may cancel your subscription at any time through the Account page or by contacting us at support@investors.cards. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that period ends. After cancellation takes effect, your account will revert to the Free tier.

9.5 Refunds. Subscription fees are generally non-refundable. If you believe you have been charged in error, contact us within 7 days of the charge at support@investors.cards and we will review your request on a case-by-case basis.

9.6 Price Changes. We reserve the right to change subscription pricing at any time. If we increase the price of your current plan, we will notify you at least 30 days before the change takes effect. The new price will apply at your next billing cycle after the notice period. If you do not agree to the new pricing, you may cancel your subscription before the new price takes effect.

9.7 Free Tier Limitations. Free accounts are subject to usage limits including but not limited to portfolio card limits, price alert limits, and restricted access to certain chart ranges and features. We reserve the right to modify Free tier limits at any time without notice.

9.8 Downgrades. If you downgrade from a paid tier to a lower tier or the Free tier, features exclusive to the higher tier will become inaccessible. Existing data (such as portfolio cards exceeding the Free tier limit) will be preserved but may become read-only until your usage falls within the limits of your current tier.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to the Service, other users, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, limitation of liability, and dispute resolution provisions.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INVESTORS.CARDS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

13. Indemnification

You agree to indemnify, defend, and hold harmless Investors.Cards and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: your use of the Service; your violation of these Terms; your violation of any applicable law or regulation; or your violation of any third party's rights.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Broward County, Florida. You agree to waive any right to a jury trial or to participate in a class action.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Investors.Cards regarding the use of the Service, and supersede all prior and contemporaneous agreements, representations, and understandings.
